Special and General Courts-Martial Results for August 2019

WASHINGTON (NNS) (NNS) -- The following reports the results of every Special and General Court-Martial tried and completed within the United States Navy in August 2019.  The cases are separated by the Navy Region in which they were tried.

Naval District Washington

      General Court-Martial

None.

Special Court-Martial

None.

Navy Region Mid-Atlantic

      General Court-Martial

None.

      Special Court-Martial

At a Special Court-Martial in Norfolk, Virginia, ABHAA Tyler L. Faulkner, USN, pled guilty pursuant to a pretrial agreement to absence from his unit, two specifications of missing movement, and wrongful use of marijuana.  On 1 August 2019, the military judge sentenced him to forfeit $300 pay per month for 2 months and reduction in rank to paygrade E-1.  The pretrial agreement had no effect on the sentence.  The pretrial agreement contained a waiver of the accused’s administrative separation board.

At a Special Court-Martial in Norfolk, Virginia, CSSN Tyre L. Young, USN, pled guilty pursuant to a pretrial agreement to four specifications of abusive sexual contact, indecent conduct, and two specifications of assault consummated by a battery.  On 13 August 2019, the military judge sentenced him to be discharged with a Bad Conduct Discharge, reduction in rank to paygrade E-1, and confinement for 12 months.  The pretrial agreement had no effect on the sentence. 

Navy Region Southeast

     General Court-Martial

At a General Court-Martial in Jacksonville, Florida, EMN1 Wendell E. Mellette Jr., USN, was tried for sexual abuse of a child.  On 16 August 2019, the panel of members returned a verdict of guilty for sexual abuse of a child and sentenced him to be discharged with a Dishonorable Discharge and confinement for 5 years.

At a General Court-Martial in Jacksonville, Florida, STG2 Antonio Olivares III, USN, pled guilty pursuant to a pretrial agreement to willfully disobeying a superior commissioned officer, three specifications of assault consummated by a battery, disorderly conduct, and negligent discharge of a firearm.  On 23 August 2019, the military judge sentenced him to reduction in rank to paygrade E-1 and confinement for 22 months.  The pretrial agreement contained a waiver of the accused’s administrative separation board.

Special Court-Martial

At a Special Court-Martial in Jacksonville, Florida, YNSR Brennan B. Borjas, USN, pled guilty pursuant to a pretrial agreement to assault consummated by a battery.  On 22 August 2019, the military judge sentenced him to confinement for 3 months.  Pursuant to the pretrial agreement, all confinement greater than 75 days is to be suspended.  The suspended punishment may be served if the Service member violates the terms of the pretrial agreement. 

At a Special Court-Martial in Mayport, Florida, QMSA Nathaniel D. Riley, USN, was tried for abusive sexual contact.  On 29 August 2019, the panel of members returned a verdict of guilty for abusive sexual contact and sentenced him to reduction in rank to paygrade E-1, confinement for 10 days, and hard labor without confinement for 30 days.
 

Navy Region Northwest

   General Court-Martial

At a General Court-Martial in Bremerton, Washington, QM2 Kevin D. Norris, USN, pled guilty pursuant to a pretrial agreement to distribution of a controlled substance, possession of a controlled substance, and use of a controlled substance.  On 23 August 2019, the military judge sentenced him to be discharged with a Bad Conduct Discharge, reduction in rank to paygrade E-1, and confinement for 6 months.  The pretrial agreement had no effect on the sentence.

Special Court-Martial

At a Special Court-Martial in Bremerton, Washington, AD3 Craig T. Perlmutter, USN, pled guilty pursuant to a pretrial agreement to two specifications of assault consummated by a battery.  On 1 August 2019, the military judge sentenced him to reduction in rank to paygrade E-3 and confinement for 60 days.  The pre-trial agreement had no effect on his sentence.   The pretrial agreement contained a waiver of the accused’s administrative separation board.

At a Special Court-Martial in Bremerton, Washington, ABHAN Victor Montealegrecharro, USN, pled guilty pursuant to a pretrial agreement to wrongful use of a controlled substance and distribution of a controlled substance.  On 8 August 2019, the military judge sentenced him to reduction in rank to paygrade E-1 and confinement for 10 months.  Pursuant to the pretrial agreement, all confinement in excess of 8 months is to be suspended.  The suspended punishment may be served if the Service Member violates the terms of the pretrial agreement.

At a Special Court-Martial in Bremerton, Washington, AO2 Domingo R. Ramirez Jr, USN, pled guilty pursuant to a pretrial agreement to assault consummated by battery.  On 20 August 2019, the military judge sentenced him to reduction in rank to paygrade E-3 and confinement for 90 days.  Pursuant to the pretrial agreement, all adjudged confinement is to be suspended for six months.  The suspended punishment may be served if the Service Member violates the terms of the pretrial agreement.
 

Navy Region Southwest

      General Court-Martial

At a General Court-Martial in San Diego, California, CDR John M. Neuhart II, USN, pled guilty pursuant to a pretrial agreement to two specifications of assault upon a commissioned officer and conduct unbecoming an officer and a gentleman.  On 27 August 2019, the military judge sentenced him to forfeit $1,000.00 pay per month for 6 months and confinement for 1 year.  Pursuant to the pretrial agreement, forfeitures are to be deferred and suspended. 

      Special Court-Martial

At a Special Court-Martial in San Diego, California, AMAA Magnus I. Grey, USN, pled guilty pursuant to a pretrial agreement to assault consummated by a battery.  On 2 August 2019, the military judge sentenced him to be discharged with a Bad Conduct Discharge, reduction in rank to paygrade E-1, and confinement for 120 days.  Pursuant to the pretrial agreement, the punitive discharge is to be disapproved.  The pretrial agreement contained a waiver of the accused’s administrative separation board.

At a Special Court-Martial in San Diego, California, AM3 Nurudeen O. Dawodu, USN, pled guilty pursuant to a pretrial agreement to three specifications of larceny, three specifications of fraudulent use of credit cards, and attempting to steal property of a value of $500.00 or less.  On 9 August 2019, the military judge sentenced him to be discharged with a Bad Conduct Discharge, reduction in rank to paygrade E-1, and confinement for 8 months. Pursuant to the pretrial agreement, all confinement in excess of 6 months is to be suspended.  The suspended punishment may be served if the Service Member violates the terms of the pretrial agreement.

Navy Region Hawaii

      General Court-Martial

None.

Special Court-Martial

 At a Special Court-Martial in Pearl Harbor, Hawaii, IT3 Maxwell Urbonas, USN, pled guilty pursuant to a pretrial agreement to indecent language.  On 16 August 2019, consistent with the pretrial agreement, the military judge sentenced him to be discharged with a Bad Conduct Discharge, to forfeit $1,537 pay per month for 6 months, reduction in rank to paygrade E-1, and confinement for 6 months.   

At a Special Court-Martial in Pearl Harbor, Hawaii, CTI3 Zsavoir Hodnett, USN, pled guilty pursuant to a pretrial agreement to conspiracy to distribute a controlled substance, five specifications of distribution of a controlled substance, two specifications of possession of a controlled substance, two specifications of use of a controlled substance, larceny, and three specifications of solicitation to use a controlled substance. On 20 August 2019, the military judge sentenced her to be discharged with a Bad Conduct Discharge, reduction in rank to paygrade E-1, and confinement for 12 months.  The pretrial agreement had no effect on the adjudged sentence.
 
Navy Region Japan
 
      General Court-Martial

At a General Court-Martial in Yokosuka, Japan, an E-4 was tried for sexual assault.  On 14 August 2019, a panel of members returned a verdict of not guilty.
 
      Special Court-Martial

None.

Navy Region Europe, Africa, Central

      General Court-Martial

At a General Court-Martial in Washington, D.C., an E-5 was tried for two specifications of sex trafficking and patronizing prostitutes.  On 13 August 2019, the panel of members returned a verdict of not guilty.
